What is SIIB? (The Full Form)

SIIB stands for the Special Intelligence and Investigation Branch.

It is a specialized wing within the Indian Customs department dedicated to preventing revenue leakage and ensuring compliance with trade laws. Unlike the regular Appraising or Assessment groups that handle day-to-day clearance, SIIB operates based on specific intelligence or "alerts."

The Two Wings of SIIB:

  1. SIIB (Import): Focuses on issues like undervaluation of imported goods, misclassification (using the wrong HS Code to pay lower duty), and importing restricted/prohibited items.

  2. SIIB (Export): Focuses on overvaluation (to claim higher drawback or incentives), bogus exports (claiming benefits without actual export), and misuse of export promotion schemes like Advance Authorisation or EPCG.

Why Does SIIB Get Involved?

SIIB does not check every shipment. They step in when there is a specific reason or "red flag." Common triggers include:

  • Valuation Mismatches: If the declared value of your goods is significantly lower (for imports) or higher (for exports) than the market trend.

  • HS Code Disputes: Suspicions that you are misclassifying goods to avoid duties or Anti-Dumping Duty (ADD).

  • Country of Origin Issues: Suspicions that goods are being routed through a third country to avoid taxes or bans (e.g., claiming goods are from a Free Trade Agreement partner when they are not).

  • Specific Intelligence: Tips received from other agencies (DRI, GST authorities) regarding a specific IEC holder.

What Happens During an SIIB Investigation?

If your shipment is flagged by SIIB, the standard "Green Channel" clearance stops. The process usually involves:

  1. 100% Examination: Your cargo will be thoroughly inspected, often in the presence of SIIB officers.

  2. Document Verification: You will be asked to submit extensive proof—past invoices, bank remittances, contracts, and technical literature.

  3. Statement Recording: In serious cases, the exporter/importer or the CHA may be summoned to record a statement under Section 108 of the Customs Act.

What To Do If Your Shipment is Stuck with SIIB?

1. Don't Panic, Be Organized

Panic leads to mistakes. Start compiling your documents immediately. Ensure your invoice value is supported by bank transactions and valid contracts.

2. Do Not Ignore Summons

If you receive a summons, you must comply. However, it is highly advisable to consult a legal or customs expert before appearing. What you say on record is legally binding and can be used in future adjudications.
