DGFT Expands GAEC Scope Under Para 10.16 of Handbook of Procedures 2023

The Directorate General of Foreign Trade (DGFT) has released Public Notice No. 17/2025-26, introducing significant amendments to Para 10.16 of the Handbook of Procedures (HBP) 2023. This update expands the scope and flexibility of the General Authorisation for Export of Chemicals and Related Equipment (GAEC), especially for exporters dealing with strategic items listed under SCOMET.

🔍 What Has Changed?

The amendment focuses on widening the application of GAEC beyond the previously defined scope. Here’s a breakdown of the key revisions:

1. Expanded List of Items and Destinations:

• Exporters can now apply for GAEC for items falling under Categories/Sub-Categories 1C, 1D, 1E, 3D001, and 3D004 (excluding software and technology), including chemicals listed in Appendix 10(N).

• This provision applies specifically to countries mentioned in Appendix 10(N).

2. New Clause for Exports to Other Countries:

• A new sub-paragraph 10.16(A)(I)(b) has been inserted.

• Exporters wishing to ship to countries not listed in Appendix 10(N) can now submit a list of such destination countries for DGFT’s consideration under GAEC.

3. Optional Documentary Support:

• Exporters may now provide supporting documents such as:

  • Authorised Economic Operator (AEO) Certificate, or

  • Status Holder Certificate,
    which may help in streamlining approvals and establishing credibility.
